La gestion du tribunal peut être définie comme l’administration à l’intérieur et à l’extérieur du tribunal. Nous verrons cependant que le concept n’est pas complètement établi dans les pays étudiés. Il se situe à l’intérieur des tribunaux, de sorte que la gestion des tribunaux ne concerne pas l’administration générale de la justice (qui est du ressort du ministère de la Justice, des conseils de la magistrature, etc.) Il ne s’agit pas non plus de la gestion d’une affaire, de sorte que l’administration judiciaire ne s’occupe pas de la mise en état (case management). Il existe un intérêt croissant pour la question de la gestion du tribunal. Cela fait partie des efforts pour éviter les arriérés d’affaires et les durées déraisonnables, aussi est-ce une question d’accès à la justice. Dans une approche descriptive, on peut dire que la gestion des tribunaux traite du leadership à l’intérieur d’un tribunal, de la relation entre les juges et le personnel judiciaire, de la répartition des affaires, de l’évaluation des juges et du personnel judiciaire, du budget du tribunal, des biens immobiliers, de l’entretien et de la sécurité des immeubles, des nouvelles technologies, des ressources humaines et de la communication judiciaire. Les tribunaux peuvent-ils être gérés de la même façon qu’une entreprise ? Dans l’affirmative, le juge et le personnel pourraient alors renvoyer toutes leurs activités à certaines analyses de rentabilité et mesurer précisément le coût de chaque affaire. Existe-t-il un risque pour l’État de droit et le principe de légalité ? La partie générale de ce livre est basée sur quinze rapports nationaux, dont cinq sont publiés dans la partie spéciale de cet ouvrage. Après le modèle exécutif et le modèle managérial, cet ouvrage propose un modèle relationnel et coordonné de la gestion du tribunal. Court management may be defined as the administration inside the court and outside the case. However, the concept is not completely settled. It is inside the courts, so court management does not concern the general administration of justice (which is within the purview of the Ministry of Justice, judicial councils, etc.). It is outside the cases, so court management does not deal with the administration of cases, the so-called case management. There is an increasing interest in court management. It is part of the efforts to avoid backlogs and unreasonable duration of procedure, so it is a matter of access to justice. In a descriptive approach, it can be said that court management deals with leadership inside a court, the relationship between the judges and court staff, the allocation of cases, the evaluation of judges and court staff, the court budget, the real estate, the maintenance and security of the building, the new technology, human resources and judicial communication. Can the courts manage in the same way as a business does? If so, then the judge and the staff could refer all their activities to certain business cases and measure precisely the cost of each case. The parties would be clients and the court would be client-oriented. Is there a risk in this for the rule of law and the principle of due process? This General Report is based on fifteen national reports among which six are published in this book. After the executive model and the management model, this book would propose, based on the national reports, a relational and coordinate model of court management.
