Crimes et châtiments dans la chanson de geste

Au Moyen Âge, le droit (coutumier – omniprésent –, canonique et droit royal) occupe une place de premier rang. Si, depuis quelques années, les historiens se sont penchés assidûment sur la place de la violence et sur les modes de règlements des conflits, les littéraires médiévistes n'ont pas encore, dans leurs recherches, consacré à cet aspect suffisamment de travaux alors même qu'il apparaît que, dès les premiers textes en langue vulgaire, les questions juridiques sont au centre des préoccupations des écrivains. Dans chaque affrontement ou tension se pose la question de la régulation des conflits, d'une certaine forme de droit de la violence: vendetta, justice féodale ou royale, coutume, etc. Le châtiment se définit généralement en regard de trois entités: la justice de Dieu, le pouvoir royal et sa justice, l'individu et le groupe dont il fait partie. Dans la fiction, ces trois grands domaines sont les cadres majeurs de la mise en scène du crime et du châtiment, ainsi que de leur légitimation contradictoire. La fiction est également conditionnée par une réflexion politique, reposant sur une conception contemporaine, inscrite dans la réalité historique du pouvoir et de l'exercice de la justice. C'est donc dans cet espace, de l'histoire à la fiction et de la fiction à l'histoire, qu'est ici posée la question du « crime épique » et de son traitement.
